Yasak case before the European Court’ Grand Chamber – first hearings on May 7, 2025

On August 27, 2024, the Second Section of the European Court of Human Rights issued its ruling in Yasak v. Türkiye, which starkly contradicted the principles established in the Grand Chamber’s Yüksel Yalçınkaya judgment (in which the Grand Chamber explicitly noted that the decision pertained to around 8,000 pending cases and affected at least 100,000 files in Türkiye).

The judgement, deeply flawed (see our position paper), was immediately used by the Turkish Government to argue in favor the foreseeability of terrorism convictions and the fairness of domestic legal proceedings.

On December 16, 2024, the Court has accepted the referral of the case to the Grand Chamber.

The judgment is now legally void and holds no authoritative validity, unless endorsed by the Grand Chamber.


The first hearings before the Grand Chamber will take place on May 7, 2025.
